Consent Orders

This service is for those who have agreed on financial and/or parenting arrangements.

When you and your former partner (spouse or de facto) have separated and have reached an agreement regarding how the assets and liabilities of the former relationship are going to be shared and/or you agree on care arrangements for your children, you can file an Application for Consent Orders with the Family Court setting out the terms of such agreement.

There is a process you must follow and it is important that you receive advice as to the agreed terms so that you understand what types of orders the Court can approve, and why.  You should understand the consequences of any orders that you agree to.

Consent Orders can be made and approved without you ever having to set foot in a Court room.

Alternatively, if proceedings are already underway, you can inform the Court during those proceedings that you have reached an agreement, and again, if the Court approves the agreement you have reached, you can obtain Orders by consent.

Divorce

Financial (Property) Matters

If you have separated from your former partner (married or de facto), it is important that you understand how the assets and liabilities of that former relationship can be divided.

There is a lot to consider including (but not only) what:

  • each of you has contributed towards the asset pool that is available for distribution;
  • each of your future needs is; and
  • outcome would be fair and reasonable for you both (yes, both!)

Parenting Arrangements

If you are unable to agree parenting arrangements for your child/children, contact us  to make an appointment to  discuss your parenting dispute and discover how we can help you navigate your way through the variety of parenting orders the Family Court can make, including (but not only):

  • with which parent your child will live with,
  • how much time your child spends with the other parent: and
  • parental responsibility arrangements.

Spousal/De-facto Maintenance

Your circumstances may mean that you may need financial support from your former partner or that your former partner seeks financial support from you.

Time limits apply as to when a Court can order that these payments are made.

So, either way, call us and make an appointment to come and see us to discuss your circumstances.

Child Support

You may have agreed with your former partner how much child support payments you are going to receive or pay and you want your agreement in writing.

There are different types of child support agreements that you can enter into, noting each agreement has certain terms and conditions which must be met.
